Sommer Haus Gallery – Terms of Use & Participation

Welcome to Sommer Haus Gallery (“Gallery,” “we,” “our,” or “us”). By accessing or using our website at https://sommerhaus.gallery (the “Site”), you agree to be bound by these Terms of Use (“Terms”). Please read them carefully.

If you do not agree to these Terms, you should not use our Site or services.

1. Use of Our Site

  • The Site is provided for informational, promotional, and educational purposes related to our exhibitions, calls for art, and gallery services.
  • You agree not to misuse the Site, attempt to disrupt its functionality, or use it for unlawful purposes.
  • We may suspend or terminate access to the Site at our discretion for violation of these Terms.

2. Artist Participation

  • Artists who submit applications, artwork, or related materials through our Site agree that:
    • They own or control all rights to the works submitted.
    • They grant Sommer Haus Gallery a limited license to use submitted content for the purpose of hosting exhibitions, marketing, and promotion.
    • They remain responsible for handling their own art sales, shipping, and any applicable taxes, unless otherwise agreed in writing.
    • They are 18 years or older and submitting your original artwork.
    • If said artwork sells, they will promptly contact us, so we can mark it that way for our online audience. You will retain 100% of the profits, in exchange, Sommer Haus Gallery/Henrichs Media Group LLC agrees to either forward all legitimate purchase inquiries to your email address or link your website to your featured artwork(s). And you, the artist, agree to work directly with the buyer to negotiate the entire sale, including but not limited to: payment/framing/shipping/etc. Sommer Haus Gallery/Henrichs Media Group LLC cannot be held responsible or liable for anything that may occur during the buyer/seller transaction.
    • They understand that entering artwork for consideration into any exhibition does not guarantee the artwork will be chosen.
    • They understand that the entry fee for Open Calls is non-refundable and will not reach out to our gallery asking for a refund; no matter the circumstances.
    • They understand our gallery is a website that exists for the Worldwide Web and every person it reaches currently, and in the future. They understand they can look at our website and how it works prior to entering any exhibition, and that our gallery is available to answer questions about how it works; before, during, or after entering any exhibition.
    • They understand our gallery does not archive past exhibitions on our website. Once an exhibition closes; their artworks are completely removed.
    • You understand we promote to our social media audience and we do not remove your artworks from these pages, even after the close of an exhibition, except upon artist request, or any other reason deemed appropriate by Sommer Haus Gallery/Henrichs Media Group LLC.
    • If your artwork is accepted to any exhibition, you automatically agree to the use of your name and artwork(s) for any social media pages we may choose to use now and in the future, and Sommer Haus Gallery/Henrichs Media Group LLC cannot be held liable or responsible for anything that may occur as a result.
    • You understand we take great pride in our gallery and curated exhibitions and agree to not reach out offering unsolicited advice and/or opinions, including, but not limited to: suggesting we reformat our exhibitions or select different artworks, criticizing our entry fees, and/or suggesting how we maintain our social media accounts.
    • You agree to not reach out to our gallery in an angry, aggressive, criticizing, demanding, harassing, threatening, or similarly deemed manner over anything, including, but not limited to: your artwork not being chosen or being disqualified for not meeting the application requirements in the open call.
    • You understand you are entering artwork for consideration at your own will and can request its removal at any time.
    • Sommer Haus Gallery/Henrichs Media Group LLC cannot be held liable or responsible for anything that may occur as a result of displaying in our gallery, including, but not limited to: artwork remaining unsold, comments made on social media, or images being reformatted to fit the parameters of our gallery.
    • Sommer Haus Gallery/Henrichs Media Group LLC retains the right to terminate this agreement and/or to remove your artwork(s) from our website(s) at any time, for any reason, and without any notice.
  • Gallery reserves the right to accept, decline, or curate submissions at its sole discretion.

3. Intellectual Property

  • With the exception of artwork images submitted by artists for exhibition, all content on the Site, including text, images, design, and layout, is owned by Sommer Haus Gallery or used with permission.
  • You may not reproduce, distribute, or use any content without prior written consent.
  • Artists retain copyright to their submitted artworks but grant Sommer Haus Gallery the right to display and promote them during the exhibition period.

4. Payments and Fees

  • Fees for exhibition services or participation are listed on our Site or within agreements.
  • Unless otherwise noted in writing, all fees are non-refundable except as stated in specific contracts.
  • Payment processing is handled through secure third-party platforms; Sommer Haus Gallery does not store credit card information.

5. Sales and Tax Responsibility

  • Sommer Haus Gallery does not act as a dealer or sales agent for artists.
  • Any purchase inquiries will be directed to the Artist, who is solely responsible for completing the sale, collecting payment, shipping, and handling taxes.

6. Third-Party Links

  • The Site may include links to third-party websites. Sommer Haus Gallery is not responsible for the content, policies, or practices of third parties.

7. Privacy

  • We respect your privacy. Please review our [Privacy Policy] for details on how we handle personal information.

8. Disclaimer of Warranties

  • The Site and services are provided “as is” without warranties of any kind, express or implied.
  • We do not guarantee uninterrupted access, error-free functionality, or specific results from using the Site.

9. Limitation of Liability

  • These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
